1. Notice of Copyright Infringement

3. Counter-Notification Procedures

If you receive a notification that your content has been removed due to a copyright complaint, and you believe the removal was a mistake or a misidentification, you may submit a Counter-Notice. To be effective, the Counter-Notice must include:

  • Identification of the material that has been removed and the location where it appeared before removal.

  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  • Your name, address, and telephone number.

Note: If a valid Counter-Notice is received, Shopxcart may send a copy to the original complaining party informing them that the removed content may be replaced in 10 to 14 business days unless the copyright owner files a court action seeking an order against the content provider.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Shopxcart has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We also reserve the right to limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
